House contract signed

I spoke with the Okal Haus consultant last Friday. He "assured" me that this was not a problem at all. If I did not receive the plot of land from my mother, then everything would disappear into thin air and the contract would therefore be terminated. When I asked if I would then have to pay any fees, he said that of course I would not need to, since Okal Haus would otherwise lose its good reputation. We agreed that I would get back in touch.

This is probably a reservation contract, or am I mistaken?

My situation is similar to what was described here before. We currently still have a property that we want to sell because it is too big for us. We have also signed such a contract (reservation of withdrawal from the house contract). It also states there that we have the right to withdraw from the house contract according to §649 of the Building Code if we cannot obtain financing by no later than x. x. 2011 (date is in the future).
Under the next paragraph it states that we must declare the withdrawal within 2 weeks from the aforementioned date which is in the future.
We were looking forward to building a new little house. But now we have concerns because my husband is no longer allowed to work due to a health problem. He will most likely have to leave the company where he worked for 12 years and find a new field of work. Since he will then be starting at the bottom, the salary will certainly be lower. Then the financing would no longer fit either. This came very suddenly and was not yet certain at the time of signing the contract. Can we withdraw from here as well? We cannot and do not want to have 2 houses.

Hello, no we are on it. All that has been done so far is that the consultant gave us the floor plans in small format, we were at the sampling center before signing. Everything else like building permits has not been done. Therefore, I think we have a good chance to withdraw, especially since the financing is also not working out if my husband has to look for a new job or undergo retraining. But we also don’t want to have to pay the many thousands of euros in penalties.

Hello,

You clearly agreed on a financing contingency to the contract for work - then it does not matter why the financing does not materialize; the result remains the same and you are released from the contract.
