Hello, so Okal Haus has released us, however:

"Dear Mrs. xx, dear Mr. xy,
after thorough review and in reliance on the accuracy and completeness of the reason for termination you provided, we release you free of charge from the concluded house contract.
Should it turn out that your information was false or incomplete, that the release from the house contract was based on this false information and/or you realize a house with another provider, we reserve the right to examine whether claims for damages or compensation against you may exist."

Does this now mean in German that we are NEVER allowed to build a house with anyone other than Okal Haus, otherwise we have to pay many, many euros?? Since another provider would receive the contract for a house worth.

I assume that you will surely be able to build a house at some point. If I have read it correctly, it failed with you because of the financing. There can be many reasons why it might work now... decreasing monthly expenses, better salary, etc.... I don't think a house provider can bind you with such platitudes. In any case, I would clarify this with a lawyer beforehand.

Of course, if other reasons were presented, and you argued with some kind of hardship cases, you should be careful.

Hello you there, yes exactly, because we first have to sell our house in order to build a new one, or rather, it was too big for us with the rental apartment and so on, so we were no longer interested in being landlords, and the bank does not finance 2 houses.

Fundamental and generally valid for all contracts for work: a contract for work is only valid when it is countersigned and thus confirmed by the contractor (here Okal Haus) within the statutory period of 14 days (unless another period has been agreed upon due to a given/specific reason) => order confirmation.

If you let the period you were contractually obviously granted, 13.12.2010, to withdraw lapse through your own fault – you have not yet held a credit discussion with your bank within this period – the contractor is not obliged to release you from the contract; depending on the fine print in the contract/company policy, the options from my previous answer apply – the seller’s offer is in my opinion pure goodwill.

The question is therefore: what does the seller mean by „another“ confirmation?
