Claims have been registered against him, so far of course without success. The lawyer is supposed to be very good, it was a recommendation from our construction supervisor, we will see.

Which claims did you file: for further fulfillment of his contractual obligations? What are the current discrepancies between the payment schedule, construction schedule, and construction status? You apparently described the completed or outstanding trades - but I still do not clearly see who is delayed in what.

We put him in default and demanded that he fulfill his contractual obligations. We have also filed for damages.



The payment plan is structured step by step according to certain construction phases; we have made all contractually agreed payments. There is no (longer) a construction schedule. I described the current construction status in the initial post. Essentially, the exterior shell is standing.

If there is (no longer) a construction schedule, he cannot really be in absolute default with the construction services, but at best be behind the counter-performances for payments already made and due. Damages for what: penalties for missed construction time guarantees, or has he already caused some damage?

There was a contractually guaranteed completion date, which has expired since June. We then set a default and set a grace period, which has also expired.

We have made claims for rent, interest, and co.
