You can also simply delete the disputed paragraph from the deed of gift and have it notarized like that. Whether you then transfer 10,000 euros to your friend or not is completely irrelevant.

Unlikely? Then just look at the divorce rate. That doesn't even include the separation of unmarried couples. So a separation is an absolutely realistic scenario. And in the case of separation, such paragraphs are unnecessary ammunition for a war of roses: He moves out and claims the right of reclamation... great.

I don't find such gifts unusual. I dare say that most couples building a house are still listed at 50% each in the land register and take out a joint loan. And then different amounts of equity go into such a project, which automatically is a gift.

Well then, just abolish these reclamation paragraphs without replacement and that's that.

As others have already rightly said: The notary is also happy to explain your contract to you in detail, with all possible consequences of the clauses. That’s what the man is paid for. (Spoiler alert: You could have nightmares about the mortgage registration from that )

Otherwise, the two best alternatives have already been mentioned from my point of view: Either you buy it from him, or the gift contract comes without this right of reclamation. Otherwise, in my opinion, it is legally too one-sided. Then you would be heavily disadvantaged if your friend becomes the crack-addicted Scientology gambler.
