Garage with access to the house at the property boundary

Hello house building forum,

we are planning a new house with direct access to the garage. According to the current plan, the garage is located directly on the boundary. The building application has been submitted, but the building authority is not satisfied with the plan.

We have received the message from the building authority that this is not permissible and that, according to §6 para. 5 of the state building code, we must maintain a distance of 3 m from the boundary, because the planned garage is not a privileged garage according to §6 para. 7 no. 1 of the state building code.

Due to the connection to the house, it is apparently no longer considered an independent building and thus belongs to the house. Reference was also made to "OVG Rheinland-Pfalz, 25.06.2009, 1 A 10050/09".

Can these regulations somehow be circumvented or are there even more current regulations than those from 2009? I also wonder why a regulation from Rheinland-Pfalz was cited, although the building is supposed to take place in Schleswig-Holstein.

Can you help me with this?

The state building code can be read on official sites by yourself. Why should an office rely on outdated versions? Show the plan you submitted.

Attached is the site plan. I have read through all the paragraphs and the case of "OVG Rheinland-Pfalz, 25.06.2009, 1 A 10050/09." Am I correct in assuming that if there is a (fire) wall between the garage and the house, it is permissible? Is a fire protection door also considered a fire wall? The construction company has planned a fire protection door there.

The problem is probably more the boundary distance to the neighbor. Although I am surprised by the rejection, if it is a normal garage with access to the house. That is quite common.

For you, SH applies. However, they do not have any extraordinary differences compared to other federal states. What is in the garage? Technology? And how long and high is it?

It is a normally built garage with facing bricks. On the boundary 8.99 m long and 2.79 m high.
