Hello house building forum,
we are planning a new house with direct access to the garage. According to the current plan, the garage is located directly on the boundary. The building application has been submitted, but the building authority is not satisfied with the plan.
We have received the message from the building authority that this is not permissible and that, according to §6 para. 5 of the state building code, we must maintain a distance of 3 m from the boundary, because the planned garage is not a privileged garage according to §6 para. 7 no. 1 of the state building code.
Due to the connection to the house, it is apparently no longer considered an independent building and thus belongs to the house. Reference was also made to "OVG Rheinland-Pfalz, 25.06.2009, 1 A 10050/09".
Can these regulations somehow be circumvented or are there even more current regulations than those from 2009? I also wonder why a regulation from Rheinland-Pfalz was cited, although the building is supposed to take place in Schleswig-Holstein.
