I don’t know this construct either! Do you have it in black and white or did your advisor just tell you? At which bank was that? The interest rate is also far too low for such a borrower-friendly product.

Notary fees can be higher if (not unlikely in a new development area) a building obligation within a certain period is contractually agreed upon. This virtually increases the value of the property for certain reasons. In return, when buying, you can in my opinion save the [Auflassungsvormerkung] from the municipality.

Do you already know the contract terms? We had to commit to personal use under threat of a penalty payment and have a security mortgage registered in this amount (which of course costs fees again) and have a return [Rückauflassungsvormerkung] registered for if we do not build within 3 years. That also costs fees.

With us, it is also stipulated that we must start construction within three years. Otherwise, the municipality has a repurchase right.

To what extent does this affect the notary and court costs? 200€ more or less are not decisive in this case.

The private loan is completely variable in amount, disbursement, and repayment. However, it will only be as high as needed to cover the missing remainder for the land purchase. Additionally, it should then be repaid upon taking out the construction loan.
