False information about the property in the exposé

First: the property is, in all likelihood (thread history, statement from the OP), fully developed, therefore there is no deception etc. by the real estate agent, but solely a (common) misunderstanding by the prospective buyers.

Second: real estate agents are _not_ subject to the liability under the prospectus for example of securities issuers. The term "Prospekthaftung" is in this discussion at least as misleading as the technical term "fully developed," because it usually refers to the liability of securities issuers etc. Correct is: agents are liable under certain circumstances (!) or in cases of gross violations for statements given to them by the sellers; however, fundamentally the agents only pass on the information of the owners.

In this case, the agent supplemented the offer with the addition "fully developed," thus made own statements. But if the property nevertheless has no connection to a public traffic area (street) and/or water, sewage, electricity, telephone, internet etc. – then the agent would have to be either quite an idiot or unbelievably brazen.

Of course, this is possible – but rather unlikely.

well, the broker is clever and builds his business.

What do other businessmen do? The ice cream dealer drives around the gravel pits with his car, the insurance agent gets 5 addresses from good friends, and the Moroccan car salesman slips cards saying "Do you want to sell your car?" on every parked car.

People only get upset about the clever broker because they have to pay. The seller also received a service. Free advertising as well as a potential buyer.

Even if you quoted someone else above and not me, I'll respond anyway: Are you sure? And have you read my ? The broker is not selling the property, but merely freely available information (the property was publicly offered). I have experienced a similar case and do not like this broker behavior either. But I also see the seller partly at fault: If he had "better" offered the property (for example by placing a paid ad at ImmobilienScout & Co.), the interested party could have found it without a broker and everyone would be happy (except the broker).
