Does the size of the house matter?

Evening guys

I have the following problem: I plan to build a semi-detached house! The boundaries were all adhered to by the architect, but now the authority comes and says it is too big! Are they allowed to dictate how big the house can be even though all boundaries have been observed? Thanks in advance ;)

Hello,

You shouldn’t complain about the building authority, but rather question your architect more closely; anyone can basically read the development plan :rolleyes:

I'm not complaining, it's just that everything was clear because the plot wasn't sufficient, so I bought the rest to build in that size, that was all discussed! And now I'm supposed to build smaller! I just want to know if they can dictate how large I am allowed to build!? Before I go to the meeting! Best regards

You need to look for the floor area ratio (Geschossflächenzahl) in your development plan. Then you basically have all the information.

I would now write that size does not matter, but the technique does. But that is not the question: Of course, someone can dictate how big you are allowed to build. As the building expert already wrote, everything should be stated in the development plan. If there isn't one, usually neighboring buildings apply, I believe §34. That means you have to adapt to the neighbors in orientation, color, etc., and height.

I can't answer that generally based on your previous information. What is it about – is there a development plan involved or is it an outer area, i.e. § 34? What was discussed between the architect and the building authority and was a preliminary inquiry made based on that discussion? Where do you want to build?
