Sorry for asking such a stupid question, but don't we have that if I only state the deviation from the garage in the procedure justification?


Well, I'm just not sure. I'll probably not make the change or have it approved again if necessary.

The authorities work rather slowly.

If only the garage deviates from the development plan, you could have separated the projects. The house according to §58 BayBO under the full responsibility of the draft designer and builder, and the garage according to §57 BayBO with isolated deviation/exemption. Construction projects according to §57 and §58 are exempt from procedures. The building permit authority can completely opt out, the municipality only has to decide on the deviation/exemption.

Now you have a construction project according to §59 BayBO, which is subject to a procedure. That is why it is slow, but provides legal certainty, at least for the points examined in the procedure. Whether you report the change is up to you. In ignorance of the caseworkers on your side, I would go and explain the change and ask what to do. If I knew they were incompetent, I would start to doubt ...
