Okay, thank you very much for your opinions and assessments. In general, it should be mentioned again that we are writing here to obtain further more objective perspectives. We do not want to "shabbily" avoid payments, nor are we so naive as not to know that extras also cost something. The move-in date is already delayed by 10 months, the developer charges well for all extra costs (which we have always duly paid), and although we have already requested an offer for the final plastering of the chimney several times, nothing came from the developer. With the thought that the developer would still coordinate this, combined with the opinion that as buyers we cannot give orders to the subcontractor, this stupid situation has arisen.

The entire fireplace was "installed by special request." Sounds to me like it is not covered by the construction contract. So the OP can commission work on it after all, right? The only strange thing is the billing through the builder instead of directly between the craftsman and the client.

Sorry, I am not here for legal advice. I only give my legal opinion if I think it's necessary - but you know - 3 lawyers = 4 opinions. But just imagine the developer charges €50,000 for the rails - it would be the same basic legal problem - but then the majority here would surely see it differently (subjective/non-legal).
