1. Our TÜV construction controller had written to the site manager before Christmas asking him to inspect the exterior wall for cracks.
No response so far.
2. I was on the construction site last Saturday and noticed that the exterior wall was not covered as promised by the site manager before Christmas.
3. Last Sunday I wrote to the site manager and the general contractor:
"...
Deficiency notice regarding the exterior wall cracks:
On Saturday we unfortunately had to find that the discussed exterior wall with the cracks was not covered as assured (see email from Mr. XXX dated 16.12.2020, 15:52), but it has now rained into the cracks and then snowed for 3 ½ weeks.
You will find a picture of the snow on the wall attached.
As recommended by Mr. XXX (TÜV), we now urgently ask for the exterior wall to be further inspected in order to assess the extent of the damage.
Afterwards, we must jointly decide with Mr. XXX (TÜV) how the defect can be remedied.
We ask you to keep us informed on this matter.

4. No email from the site manager and general contractor regarding this to date.
5. Instead, the following email from the general contractor today:
"...
The current weather conditions do not allow for work to be carried out.
As soon as work is possible again, it will be resumed immediately.
This circumstance will affect the completion deadline.
If the announced “mega-lockdown” is decided in Germany in the near future, this will also lead to further significant delays.
We again ask that, in accordance with the contractual agreements, the construction site is not entered alone or without authorization.
Especially at this time, the risk of accidents on the construction site is much too high.
If not everyone together adheres to this agreement, we will unfortunately have to exercise our house rights according to the contractual regulations in the future.
Please schedule site appointments as already repeatedly communicated with the site management XXX.

7. A structural carpenter advised me based on the pictures to demand that the cracked areas be chipped out and newly shuttered/poured.
