Well, but a thermal bridge or, on the other hand, consequential damages are certainly more serious.

In my opinion, the line between a minor repair by informal means and criminal intent has already been crossed. That is not your problem, but I advise you to have the condition documented by an expert before and after the replacement. Incompetent people manage this "with ease," so that later it will be said "Operation successful, patient dead," meaning the window itself is flawless, but the reveal looks like it’s from a special forces training building.

Only legal assistance will probably help.

That is a defect, especially if it has already been painted over, it must have happened during installation. If the normal way doesn't work, consult an expert. And then it must be clarified how the crack came about. But actually, one wouldn't only notice that a year later, right? At the latest when cleaning the window, I should see it?

Until the handover of the house, the area was completely covered with the edge insulation strip. After moving in, we didn’t notice it immediately because the crack was covered with paint.

After another objection, I have now received the following feedback:
Option 1: milling out the damaged area and then re-bonding the area. The whole thing should then be covered with moldings, as the damage would otherwise remain visible.

Option 2: replacing the entire window frame, which is expected to cause damage to the plaster and the exterior area.

The construction company prefers option 1. According to their statement, no disadvantage would arise for us.
However, we have concerns that the area might continue to crack, although the damage would not be immediately visible since it would be covered.

What do you think?

Where there is a crack, there is tension inside. Makeup can't help with that. Broken is broken and can only be replaced by a whole. We are not talking about a scratch here.
