Hello community,

unfortunately, we have a small "problem" with our architect. We are planning a 1.5-story single-family house with a double garage. After the preliminary planning, our architect created and handed us a cost estimate according to DIN 276. The cost groups 300, 400, and 700 were listed there. For my concern, cost group 300 is important. This amounted to an amount X.

After building permit & co, we have now received a contract for work where no windows+doors, floor coverings, excavation, construction site toilet, and fence are included. The last two items were promised to us as "included" from the very beginning. Now the problem...

The amount that appears on the last page of the contract is the amount X+3000€.

We are currently somewhat less cheerful and have asked the architect to check everything again. He said he skimmed through the contract again and found nothing else. After several questions about how this can be, it turned out that the double garage was not included in the cost estimate. Strangely, every document states that we want to build a single-family house+double garage. He can’t just suddenly say that it has not been included the whole time, can he?

On other documents where the cost estimate had to be entered, the same price as in the estimate according to DIN 276 (without cost group 700) was calculated and entered. Of course, with the title single-family house+DG!

I have already done a little research and found little suitable. Can you give me some builder tips??

The post is actually not confused... rather our situation

In short... the price in the contract for work is not right!

The contract for work now only includes the pure structure (walls+roof+screed).

In the cost estimate, the complete building has to be specified, right?
Because compared to the estimate (only cost group 300, structure) the price has slightly increased. The problem is.... windows and floors actually also belong to the structure.... and they are not included in the contract for work (and should not be)

After a phone call, the architect said that the garage was not included in the cost estimate. But it is listed with every application and every cost estimate. The architect now explains the additional cost with the "additional costs" of the garage. That can’t be, right?

Hello,

maybe I'm really missing something here, but if you build with architects, you always only get a costestimate in advance. That the actual costs can then be 15 - 30% higher is how it is when building with architects. They simply don't provide fixed prices like a general contractor.

Otherwise, I probably wouldn’t have asked. To me it reads as if the cost estimate was exceeded by a factor of TEUR 3 and these costs, which I can hardly believe, are supposed to be the extra price for a double garage.


Are you doing the interior finishing including the window and front door trades on your own?


That is not a problem, because the architect can work based on the specifications from the fee agreement. So at first, there is no “must”; the decisive factor is always the contract between client and architect.


For that, I would need to know what you contractually agreed. In my opinion, you can assume that having a letterhead in the subject line as “proof” is not enough. The costs of the double garage must also be listed. It’s similar to “furnished” house designs; you also only bought the house and not the depicted furniture.

The fact is, there are many rulings, up to the Administrative Court, that overruns of the cost estimate up to 15% are within the tolerance range. TEUR 3 should more than cover that.

I actually only know architects' houses that ended up costing more than originally planned.

If the €3,000 are the only costs exceeding your budget, light a candle of thanks in the church every day.
