As you describe the situation, no conversion is necessary at all. Has anyone raised any issues regarding the buildability?

Who says that? Where is it designated?

Then you just have to wait until it is approved, and no one can deny anymore that your plot is a building gap and therefore buildable according to §34 of the Building Code. Or is there perhaps a development plan being prepared?

Hello,
thank you very much for the detailed answer. We visited a construction company and they said that there could be very big problems because the property is not official building land. I got the information about the property directly opposite from the neighbors with whom I regularly communicate to find out their situation. Unfortunately, there is no development plan, but thank you very much for the hint regarding the building gap.

We had exactly the same case. However, it was not us who had problems with the entry in the land register, but a financing bank (not ours).

Result after numerous phone calls:
- the entry in the land register only reflects the actual usage (relevant for property tax A or B, as well as statistics)
- the entry has no influence on the development, statement from the surveying office (responsible for maintaining the cadastre, which is transferred into the land register): area in the inner district, after measuring the house it is reclassified to "building and open space."
- the decision about development is made by the district office. Basics: inner district, zoning plans, land use plans, etc.

The builder says this because it was confirmed to me by the district office and surveying office: many bankers still don’t understand that the entry has no influence on the buildability. The district office even showed me areas that are recorded in the land register as "building and open space - building land," but where development is not possible due to outer district, landscape protection, flood risk, etc.

Ignore the land register. Ask the district office.
