Hello dear community,
sorry that I’m only now able to reply...
We actually engaged a lawyer immediately after receiving the payment request...
He gave us the tip to simultaneously research similar cases, and that’s why my question on this topic is only coming now.
The opposing party has rejected the previous letters from our lawyer, and it will probably now lead to a lawsuit against us.
So I think the only advice is to go directly to a specialist lawyer! However, the chances shouldn’t be that bad because a €60,000 penalty on a net construction sum of €170,000 could well mean that this penalty clause and possibly the whole contract are invalid.
BUT that is what the specialist lawyer will advise you on, and you should consult one promptly!
Yes, we have taken legal advice.
He is not looking for legal advice here, but for “fellow sufferers” with whom he can exchange experiences. I find that legitimate. Such a thing can make you sick.
Yes, that is exactly right. I am trying to find affected people who might have had similar experiences and could share them.
What good does that do for the OP? That has to be settled with legal help. Otherwise, it really makes the OP sick.
I wasn’t aware that scammers work with lawyers. "Net construction sum of €170,000 and being asked to pay €60,000 within a few days" is interesting to see if that really happened. Who builds a house today for €170k?
The contract is from 2021 and of course, it was not a luxury option.
The opposing lawyer also directly offered in his initial letter that we could pay in installments.
