Consumer construction contract, construction contract not executed - compensation for damages?

I know all that well, I was referring to the implicit (and explicit) statements of the OP in connection with posts that he will already have to pay.

So I think the only advice is to go directly to a specialist lawyer! However, the chances shouldn’t be that bad because a €60,000 penalty on a net construction sum of €170,000 could well mean that this penalty clause and possibly the whole contract are invalid.

BUT that is what the specialist lawyer will advise you on, and you should consult one promptly!

He is not looking for legal advice here, but for “fellow sufferers” with whom he can exchange experiences. I find that legitimate. Such a thing can make you sick.

What good does that do for the OP? That has to be settled with legal help. Otherwise, it really makes the OP sick.

I wasn’t aware that scammers work with lawyers. "Net construction sum of €170,000 and being asked to pay €60,000 within a few days" is interesting to see if that really happened. Who builds a house today for €170k?

The total amount of the claims is certainly exaggerated, but one will hardly get out of this situation without any payment.
One cannot seriously hold the view of signing a contract, then saying "No" five times when the contracting party proposes a plot of land, and then be released from the contract with "I simply do nothing."

As long as the contract exists, the client can come around at any time and say, "I have found a plot, please build the house on it promptly." That means he has to "block" a certain capacity for the contracts he still has to fulfill.

This may seem strange to some, and in practice certainly not a craftsman will be "blocked" for 2 years. But the contractor could accept other orders during that time, with new prices. That means he actually loses profit if you believe you can dissolve the contract by waiting it out.

This is an explanation of why, even if not EUR 60,000, certainly 10-15% of the contract sum as damages is acceptable.

PS:
Let’s consider the extreme case where 10 out of 20 people per year back out on the contractor in this way. Then basically, he can close the business if he does not demand damages.

Hopefully, this is understood as the total sum of the claim and attorney's fees. Which unfulfilled cooperation obligations are being accused of you at all? I don't recall any variant of this scam that would require further cooperation obligations beyond the stupidity of signing (and thanks for closer hints as to how a new variant differs).
