Hello,
we have a carport on our property (Brandenburg) that occupies about 13.5 m of boundary construction along two property lines. We now want to set up a garden house measuring 3x3 m at the property boundary, which according to the maximum allowable boundary construction of 15 m is no longer permitted. According to BbgBO, the carport and a garden house of this size without a living area are generally exempt from approval.

Since we do not want to do without the garden house, the question for us now is what consequences we face if we still put up the garden house and thus exceed the boundary construction by 1.5 m. In the case of an obligation to dismantle, we could shorten the carport by 1.5 m in length and thus comply with the 15 m again. But what about possible fines?

Regards
Jochen

Weren't the 15m for the entire property boundaries in total and a maximum of 9m in one stretch.

P.S. yes, that's how it was
"The exterior walls built along the property boundaries must not exceed a total length of 15 m and a length of 9 m along one property boundary"
Accordingly, it can even happen that you have to demolish the carport again if someone complains or the building authority finds out. The municipalities are usually a bit more relaxed about it.
Unfortunately, I cannot say anything about the fine.

But nowhere in the initial post does it say that the carport on a boundary side is longer than 9 meters?

Well, I interpreted it that way at the time :p But you're right, it’s not stated 100% like that

I have just one thing to say about this. Judge your neighbors properly. And then decide whether you want to settle it briefly in person or how you want to proceed. Our direct neighbor also allowed himself a bit more leeway with the 9m length on one side. In addition to the carport, there was also the garden house attached at the back. It doesn’t bother me. And he didn’t talk to me about it beforehand either. And our 3m high hedge is also directly on the boundary even though it shouldn’t be. But it doesn’t bother him either. We get along very well and don’t start a fight over something like that. You just have to be a bit relaxed.

You have already received the correct answer from Dimeto. You can also post the plan here.
Here is the plan I found.
