Buy land as land with development potential

Not only in Bavaria. We have also often seen local farmers engage in local politics until the field becomes building land, a desired road is built, or the next chicken fattening facility / the next biomass power plant is approved. Our property was declared garden land in the notarized purchase contract, which initially puzzled us. However, all the plans had already been drawn up a long time ago.

This document is not worth the paper it is printed on without the land use plan, because any building permit approved based on it could be challenged – by any German citizen, regardless of whether they live in the deepest Bavaria or on the Danish border – and then the criteria for building in the outer area would apply; which in turn basically only applies to privileged construction projects, under which ordinary residential construction clearly does not fall.

If you actually have such a document in your hands, then the person who signed it at the office is – to put it very kindly – a "no-risk-no-fun" type.

@ Dirk Grafe: The matter is a bit more complicated. But yes, it is an inner-city area and developable according to §34 Baugesetzbuch. All good.

: Don't get me wrong - of course I wish you all the best and that your construction project gets approved by the building authority as smoothly as a hot knife through butter. Even if, according to your assessment, it is somewhat more complicated (which doesn't surprise me but is to be expected) - as a mod/planner, one must point out that building according to §34 simply does not follow the usual expectations.

The crux is that the new building project must "fit into the surroundings in terms of type and scale of use," which is more or less a flexible clause. Future builders naturally tend to assume that their building project fits into the surroundings - but the building authorities may assess this differently.

In this respect, I wish you much success in unraveling the complications - most points can actually be resolved. However, it remains very individual under §34.
