If the leasehold contract were not extended, the building would indeed belong to you. But as I said, this is not about lease.

That is so, the ground lessee is at no time the owner in the land register. Since this part of the internet does not recognize links, you had to google.

This concerns a signed purchase agreement that has been made but not yet executed. Does the seller still have a chance to kick out the buyer and appropriate the begun construction? I think not. Only in the case that the buyer does not pay, then [Auflassung] is rescinded and everything that depends on it. But the buyer does pay. So, I think he can build if the seller presents the deletion approval of his bank. I would wait for that.. Karsten

Karsten needs money from the bank. The bank does not pay if it is not in the designated rank. Otherwise, it has no security. The rank is still occupied by the old land charge of the previous owner. The old one out, new bank in, pay the house = transfer of ownership according to the contract, then build. Unfortunately, it takes time because the land registry office is involved twice. Maybe the new bank will accept the notarized statement that he has initiated the creation of the land charge.

So from the bank's side, it should not be a problem. We have already notarized the land charge, it will just be registered only when we become the owners. I have also specifically asked the bank whether we can sign a loan agreement even though we are not yet owners. That is possible. Even without a land charge, we would get a loan, it would just be more expensive because the security is missing.
