Building inspection of illegal construction takes place

Hello dear forum members,

I have a somewhat more complex issue here. I am planning to buy a house with a basement garage. This garage was crossed out in the building application after being rejected by the building authority because there apparently must be no access from the house to the attic of the garage and the window on the boundary is not permitted. However, this garage was built according to the plan despite the lack of approval. Year of construction: 1996. At the final inspection by the district building inspector, this garage was already standing and was not criticized. What consequences threaten here if this "illegal construction" is discovered? Or is it perhaps not one due to the inspection?

In the worst case, a demolition.

The question I ask myself is whether it can even be considered an illegal construction, since the building authority has approved this building. The garage is built together with the residential house.

You cannot approve something that never had a permit. The garage could have been "overlooked" by mistake. However, that was not an approval.

Illegal construction remains illegal construction. In the worst case, demolition. And don't believe that building authorities will never go that far or that you can already fix it with money. I had such a case in my family. My renovation project was also an illegal construction but was legalized through a change of use application. I would advise you to possibly consult an architect to see if a change of use could also help in your case.

Let the seller legalize it before he sells. Currently, the competition is likely to be thin, so I wouldn’t risk buying it and not getting it legalized.
