Building Energy Act calculation - is it necessary? And who does it?

I doubt that, because the DIN is a technical regulation, whereas the Building Energy Act belongs to public law. But well, I could not quickly find any requirement for the submission of proof of compliance with the Building Energy Act in the Bavarian State Building Code. In NRW, it is regulated.

No, it definitely does not guarantee that. It is regulated in the AVEn - Regulation for the Implementation of Energy Industry Provisions -.

According to federal law, every builder must prove that the requirements of the Gebäudeenergiegesetz are met. When and how this is regulated is determined by the states; you can read about it for NRW in the “Verordnung zur Umsetzung des Gebäudeenergiegesetzes”.

This is the state regulation for NRW, the TS comes from Bavaria and therefore cannot do anything with it.

According to the Bavarian AVEn (§2), the lower building supervisory authorities (building offices) are responsible for the implementation of the Building Energy Act.

In §5 para. (1) it states that before the start of construction, a declaration of fulfillment (whatever it may be) regarding compliance with the requirements of the Building Energy Act must be proven. Presumably, this is something like a thermal insulation certificate?

Oh sorry, about NRW. No idea how I came up with that. But regardless of which federal state, you probably can't get around it because of federal law. I looked it up a while ago because our energy consultant was reluctant and not very forthcoming.
