Building acceptance and final installment due date

I don't know your contract design. But just to be safe, write down everything important to you in the protocol. I would definitely include a deadline for defect rectification. 3 months is already very long here! Final payment: it's in the word itself. When everything is finished. That means, if the outdoor facilities are still missing, this is a remaining service yet to be provided. Therefore, everything can only be paid out once everything is completed. The money you withhold until the end must enable you to finish the work yourself with other companies if necessary.

So with my condominium from the developer back then, it was arranged so that the "final installment" still had to be paid by the handover of the keys (without it there was no key), but with the notary there was a bank guarantee for the last 5% which was held until the truly complete completion. So if defects had not been remedied, I would have had to inform the notary that he may not return the guarantee.
Unfortunately, I did not do that despite outstanding defects (dates for rectification had already been agreed, most of it was also done, but my apartment door with slight moisture damage was not replaced in three years).

But the guarantee is also stated like that in the contract. So if nothing like that is in your contract, I wouldn’t pay the last final installment before completion either.

Hello, it was the same with us. Final payment before completion of the exterior grounds. We then did a separate acceptance.

Do you still know whether the completion of the outdoor area was recorded in the protocol at a later date during the building acceptance or was it already agreed in the purchase contract?
