Boundary distance for areas smaller than X

Hello everyone,
how is the setback distance regulated for clearance areas in NRW?
I think I once read somewhere that building parts smaller than 3m do not always count. The background is that we want to apply clinker bricks and had the idea to only clinker 2.95m high on the front left and right sides of the building and 4m high to leave a white strip in the middle. However, we did not want to move the building, but only the 10cm of the minimum distance from the curb backward. Is that possible?

Hello Simon,

this refers to subordinate components. However, there is a theoretically continuous wall to which the clearance area relates. In your case, if I have understood correctly, that should be the boundary wall if it is partially interrupted and offset inward/negatively there.

Or do you partially build in such a way that a projection compared to the main wall is created? If yes, how wide is the entire wall? How wide are the projections and how many projections are to be made?

This can and must be clarified by your architect.

Ok, I just read myself that you are only allowed to rebuild a maximum of 1/3 of a building area per side in this way. One more question. If you look at the building regulations here [Link removed, please observe forum rules] and paragraph 14 states that you are allowed to add up to 0.25m of brick cladding afterward for thermal insulation of the building. Quote, (14) For existing buildings, subsequent cladding or facing of exterior walls as well as the subsequent raising of the roof covering is permissible if the construction measure serves to improve thermal insulation and if the thickness of the cladding or facing or the raising of the roof covering does not exceed 0.25 m and the remaining distance to the neighboring boundary is at least 2.50 m. Furthermore, lesser depths of the spacing areas may be permitted taking into account neighboring interests and fire protection concerns if the construction measure serves to improve thermal insulation. Sentences 1 and 2 also apply to exterior walls whose spacing area does not comply with paragraph 5. So can you first build Kfw70 with plaster on the outside and 3m distance to the curb. And later simply add brick cladding, since there is always some purpose for insulation :) Could this work? The background is our property, we are building a small house in the city and although we have 410 sqm, unfortunately, we are already building almost square around the building at the limit regarding the boundaries, so every cm counts now! PS, Our architect assigned by the construction company is difficult, has private problems, doesn’t respond, a catastrophe...

The idea of retrofitting insulation/cladding is legally feasible, but in my opinion it is not worth it or I cannot imagine it.

Do you have such a poor plot layout? 410m² is usually more than enough.

Roughly it looks like we only have 17.76 upwards. Of that, 3m to the street, 8.75m the house, and 6m to the upper boundary, so only 1cm left. Horizontally, because of the projection, we only have 11.80m. So 3m distance to the left, 8.75m the house. So then, because you are not allowed to hit the projection, only 6cm left. It would be a good idea there to brick it afterward! If that is allowed.

Why do you have to maintain a boundary distance of 6 to the north (top) and 8.26 to the east (right)? Is the building envelope that small?
