Balcony on garage on boundary

Hello,

I have a question about the use of a balcony on a garage that is on the boundary with the neighbor. Does the 3 m distance to the neighbor also apply to this? So if the garage is 4 m wide, can I make the balcony at most 1 m wide, or if the garage is only 3 m wide, is it not allowed at all?
We live in NRW, I think that is also important.

I think your thoughts are going in the exact direction.

That is the protection of privacy: unimaginable, if it were allowed that neighbors could look down on me directly from my property. Nobody wants that, not even you!

But what is correct now, if I want to have a 6 m wide garage, may I then use 3 m for the balcony? Then I would basically keep 3 m distance to the neighbor?

A garage on the property boundary is virtually "privileged." However, if you build a roof terrace on it, it loses this status and you must again maintain the 3-meter distance. So either shorten the terrace by 3 meters (which would be possible, among other things, with your double garage) or maintain the 3 meters from the property boundary with the garage.

We are currently dealing with this point as well. Since we are still in the planning phase, we prefer to maintain the 3 meters from the property boundary so that we can plan the entire terrace, but this increases our property frontage to ~30 meters, which does not necessarily make the search easier.

A garage on the property boundary is a privileged structure that may not be used for any other purpose. Such a garage may also not be converted into an office or similar, as the structure would then lose its privileged status and would no longer be allowed to stand on the boundary. The same applies to a roof terrace. To my knowledge, one is not even allowed to construct a roof terrace with a 3m distance from the boundary. A balcony that hovers above the garage and does not rest directly on it, however, would be approvable if the prescribed boundary distance is observed.

Do I understand correctly that you are already planning a roof terrace on a garage even though you do not yet have a property?
