Legally, it is nonsense to refuse a use requested in a WA because it would be rejected in a WR. However, it is also factually nonsense to hang your well-being on whether you can move your office into your de facto basement. No one will be able to refuse you a tax document reading room with Elster connection (also used for online banking and equipped with an answering machine and fax). But you should not seriously strive by all means for cabin fever from sniffing only prison light through a basement window full-time.

Just a question out of interest. What do people who work at 5:00 PM in winter do? Are they not allowed to work anymore through the window due to lack of light? Or the supermarket cashier in the windowless Penny? There are large area lights that simulate daylight. Why do they insist on "real" light for a workplace?

I still believe there is a big misunderstanding at some desk in your building authority. During the determination of the development plan, there was probably the understandable idea that no cosmetic studios or small insurance agencies should be operated in the back house. This good intention is now driving actions, but with general decisions that, in my view, do not take into account the diversity of professional activities at all. From my perspective, this is not justifiable from a construction and/or administrative law standpoint. Or as aptly put it: nonsense.

It is about the definition of a living space. This also concerns ventilation.
