I agree with the previous speakers, where there is a will, there is a way.

1- nothing has happened yet
2- Worst case, to avoid disappointing mom, you sink 30k

I would also never rely on general statements from the contractor, he only wants to sell to you. This is not legal advice.

I would be happy if you keep us updated. A piece of advice for you, clarify everything not only orally but also have it handed over in writing by the city or have the clause removed.

First of all, get clear about "why" the city includes something like that.

They don't write something like that in there for fun. Either the property price is correspondingly cheaper or they want to protect themselves against investors.

In any case, they have a good reason for it.

Alternatively, you can also argue like this: I will work in the South for another 10 years, earn very good money there... so I am happy to pay the additional 250 euros/month.

Can your mom even build on her own or would it be a construction project where she partially finances her part of the house (at least partially)?

I rather think that it makes little sense to pay the penalty over 10 years, even in installments.

Although I have considered it, my mother said to me just last week that I should take the risk and keep the job, and if necessary, she will pay half as well.

My mother wanted to build already 3 years ago; back then, there were only a few plots available, but unfortunately, she didn’t get one from the lottery at that time. My mother is now 60 and can finance the house. She only needs a small construction loan because she has equity.

And since my financial situation is also better right now, I’m practically building on half of my mother’s plot, which she has acquired. The plot is now being divided in half, with a partition statement, notary, etc.

The current status is that due to the plot division, the appointment at the notary will soon take place, where each will be entered separately in the land register. That way, each can sell their half later if they want to, and above all, no one will be held liable if one of them gets into financial difficulties.

I think the appointment will be scheduled within the next two weeks. I will definitely sign, because if all else fails, I will look for a new job.

My wife told me just yesterday that we should move, and if it doesn’t suit us, we can basically move out again after 5 years, and then the house could be rented out legally.
