Wrong roof tiles: glossy instead of matte

Hello everyone, to my surprise I found out today that the roofer has installed or at least laid on the roof shiny instead of the agreed matte engobed black tiles. We are meeting with the roofer tomorrow - he has already said that it was a wrong delivery. Now I am unsure about what we should do... Surely we could demand an exchange, but I don't want to push the gentleman into insolvency -.- (although it probably wouldn't be that dramatic). The development plan allows both - the house opposite also has shiny engobed tiles. However, I have read that neighbors can sue against this - I want to prevent us from leaving them on now and someone complaining in three years because they are glaring. What do you think about it?

Hi!

In my opinion, there are two options:

a) Have it replaced

b) Obtain written approval for the other brick from the responsible building authority and negotiate with the roofer accordingly

If they are permitted in the [Bebauungsplan], I see no problem.

If you ordered different ones and you do not like the ones installed now or there could be other problems, then have them replaced! I don't understand why there still has to be discussions about this. The roofer made a mistake, so he has to fix it. Or do you want to pay the full price for a faulty performance?

When did he realize that? Before or after processing? If the former: He should do an unpaid internship at the hardware store as punishment. Or something like that. So have the items exchanged, if you give in, you have to worry that this will continue on your construction site.

Basically, I agree with my predecessor - but if a corresponding discount comes out of it, and the builder (and especially his better half ) can maybe live well with it - why not? I wouldn’t let it go for 100 euros either, but with appropriate "compensation" (what do you think would be realistic?).......
