Because of the defects, no lawyer is necessary yet. So far, the OP has done everything correctly.

But what will follow now requires specialist technical expertise.

I ask again, are you building all 3 units?

Sorry, I had overlooked that. No, we are three builders in total. However, we are in close contact and coordinate very regularly. The other two builders are also "fed up" and are going to the same lawyer so that he can represent all three builders.

Is this a property developer or a contractor?

I am asking because the cellar was constructed by another contractor.

Is there photographic documentation of the partition wall in the cellar and ground floor (especially the insulation in between)?

Somehow I'm too stupid to find the "Edit" button. It is a general contractor. He only works with subs. He basically has quite consistent partners and has been on the market for almost 12 years. Unfortunately, his "regular structural builder" fell seriously ill with Corona shortly before the start of construction on our house (we even had talks with him) and has now been in the hospital for over 6 months. Therefore, the GC is currently probably looking for a reasonable new structural builder. I can't judge how the quality of the original structural builder would have been, but it could hardly have been worse :D
