Because you can't change it anymore – unless you completely remove the window to replace the sealing tape. But that is probably ruled out due to proportionality.

That is now the question with my windows. I have not yet paid 100% of the amount. Can I say, "Wrong sealing tape, because it is simply not fixed/hard everywhere and detaches very easily from the reveal in some places. I want to withhold part of the amount"?

I mean, the airtightness is controlled by the exterior plaster anyway. So a small gap shouldn't be that serious now. And if I have to pay a few cents more per year in heating costs because of this gap, that's why I’d negotiate an amount I do not want to pay. Does that sound like a plan?

Hello,

there is no proportionality in the case of technical defects, but he can technically repair his defect equivalently. I think he could at least improve a sealing tape from the inside (not the one that goes into the joint but the classic one that is glued to the wall and the window). Then it is airtight.

if the plaster now cracks there, you have a problem again. In addition, with drafts, less the money through heating costs but rather the well-being is decisive.

So I would definitely file a defect notice and also withhold money. I don’t know your contractual situation, but as a rule, 10% is acceptable as a “contract performance bond.”

You can definitely object to it. I wouldn't be satisfied with that. A seal should also be a seal and not just an attempt at one.
Here is my notice of defects:
Hereby I report defects in the installation and sealing of the windows.
Reason:
The installation of the windows must be carried out in accordance with the currently applicable Energy Saving Ordinance.
The application of the sealing on the window must be done in the non-installed state.

Between the window frame and the masonry, complete insulation must be installed as thermal and sound insulation, i.e., without gaps.
“According to regulations, the [B]space[/B] between the sealing layers must also be completely filled with a thermal insulating material (insulation).”
The installation must be carried out by a specialist company that issues the client a contractor declaration confirming proper installation and compliance with the Energy Saving Ordinance.

Deadline for defect rectification: by no later than xx.xx.xxxx

No, of course I did not pay that, but the general contractor did. As long as you do not accept the windows and their sealing, he must ensure they are free of defects. It is not about a few cents in heating costs, but about condensation and mold formation inside, and those are real problems. You have the right to withhold twice the estimated cost of defect remedy.
