Trouble with the property developer, don't know what to do anymore

Hello community,

I hope you can help me.
I don't really know where to start.
We have been living in our semi-detached house that was built for 2 months.
During the entire construction, there were repeatedly problems with the builder. Appointments were not kept, appointments were made and no one showed up, we had water in the basement because something was not done correctly here, etc. etc. I could now make an endlessly long list.
Since the water in the basement issue is still current and, as I said, we are now living in it, we no longer know what to do. The builder actually promised us completion in calendar week 36, nothing happened, we then asked and got the information that the craftsman was still on vacation but would come on 07.09.19. As expected, no one came. The builder does not respond to my email. In addition, there are still small jobs open whose completion was also promised to us by calendar week 34 - nothing has happened.
Do you have any suggestions what I can do? We are especially worried about the basement.
I have now considered a lawyer because I don’t know any other way, but that would be the last option...

Have you already paid in full? Hopefully not!
If not, you still have an amount in hand that can be used as leverage.

Fortunately, we have not paid in full yet. But the amount still outstanding apparently does not matter to him, at least it brings nothing as leverage....

I would invest the money in a consultation with a lawyer so that you are on legally safe ground. And then (unless the consultation indicates otherwise): set a deadline in writing and communicate that if the defects are not remedied within this period, you will arrange for the remedy yourself and use the withheld sum for this purpose. Hopefully the money will be enough for that... With such business partners, you really can't separate soon enough...

Do you happen to know how it works if we now contract the work out to an external company regarding the warranty? We have a 5-year warranty and if we independently assign this to another company now and something happens during that time, I’m just afraid that the developer will say, well, that’s related because the company you hired didn’t do it properly.

You have to ask the external company! In reality, it will look like the developer and the external company will pass the blame back and forth. Unfortunately!
