Yes, maybe, but as and have already written, the slope is not stable like this and requires structural support. Also, the dimensions in the top view are not visible and thus neither are the boundary distances. Furthermore, we do not know the text and any conditions in the building permit and do not know how the people at the building authority 'are about it. It is clear that the embankment triggers clearance areas and is therefore relevant to neighbors, which can be another source of trouble. Therefore, I do not think it is wrong to express concerns that can then assess for his case.

So actually all relevant boundary distances can be seen: 3 to 3.61m to the only boundary affected by this embankment.

There are two conditions. The first deals with compliance with the floor plan areas and height levels after the base slab and the basement have been constructed. The second concerns proof that must demonstrate compliance with the Renewable Energy Heat Act.

All embankments are within the 3-meter boundary all around. Aren't neighbors then out of the matter anyway?

That is what I mean by "assess for his case." Not all relevant facts have been known until now and cannot be known, as the employees of your approval authority cannot imagine this here. You asked for opinions, I have given mine and justified it, has expressed his. Unfortunately, he criticizes the discussion itself and makes the topic ridiculous with exaggerated and IMHO inappropriate comparisons. The fact remains, you want to deviate from the building permit. I can name building authorities where I would say "Just do it!" without hesitation, with others I would first ask for the responsible caseworker, and with others I would definitely advise an addendum.

I am also very grateful to you for your detailed feedback! That is exactly what I had ultimately hoped for. (By the way, there are so many forums where I have missed exactly that in the past :-/ )

Since we’re already at it and I see that you also come from the NRW area: Would you privately name some for me? Maybe ours is accidentally among them.

Sorry, no. I avoid hints that could lead to conclusions about my identity, as I have also experienced here how irrational users can become, and I do not want to lose the possibility of an appropriate response if there is a risk of eventually finding four flat tires. No, it is not.

Oh, then you seem to know which building authority is responsible for us. Well, that's a pity, but nothing can be done about it. Maybe "I can name building authorities for you" was a bit unfortunate phrasing, because now it sounds like "I can name building authorities for you, but won't do it". Be that as it may: The architect is being consulted and we are curious to see what comes from her side. If you have any other suggestions: I am open to any feedback.
