Terminating garage contract, not recognized?!?

Hello everyone,

we have/had a plot of land in prospect. "Back then" we received a good offer for a "garage," with a clause that if we do not obtain a building permit, we can withdraw free of charge.

Now we have received a letter from the city stating that no permit will be granted due to the water law permit (which is not available). (The background is that the area is a flood zone.)
Now this was rejected by the company xxx because we can still apply for a water law permit. I know, we were stupid and naive.

How do we get out of this now? Anyone have a suggestion?

Why don't you simply submit the application for the [wasserrechtliche Genehmigung]. This will probably be rejected and you forward the rejection to the garage company. No permit, no construction.

Yes, that's what I thought too. Then I asked the authority what it would cost me. Quote: Roughly, for me, with a 200 K € reference price, it would be about 2600€ ops:

Do not confuse water law approval with building permits, do not confuse the costs to be applied for building permits with the correct costs.

The plot was probably officially sold to the OP only as a motorhome or vehicle parking space, since there is no development plan, with the verbal assurance that construction would be only a formality (for example, because the neighboring plot is already developed).
