Hello
we received an invoice from the team three weeks ago. As always, the request for payment was sent to the construction financier. Then suddenly it was said: This invoice must now be paid by the KFW intermediary bank so that both lenders are proportionally balanced.
Today we received a letter from our main financier. The letter includes an extra invoice for 1000 euros processing fee. Reason:
Your Kfw bank pays only after we have disbursed our entire loan amount, we adhere to the real estate agent and developer ordinance... which they do not.---so here come the 1000 euros!
Actually, the Kfw contract states we only pay after the entire loan amount has been disbursed by the first-ranking lender listed in the land register.
Can my house bank simply not comply with the real estate agent and developer ordinance?
And does the real estate agent and developer ordinance really say that payments cannot be made sequentially?
What also surprises me a lot is that I am not the first borrower who takes out construction financing with a large well-known insurance company and has the Kfw loan running through my house bank (also large and well-known)?!
