§ 19 Baunutzungsverordnung (Baunutzungsverordnung) allows an exceedance of the permissible floor area ratio through ancillary facilities up to 50%, even a floor area ratio of 0.8 is permitted and can be approved.

But this information is useless here if there has already been consultation with the building authority. The floor space index was, for example, not mentioned at all.

It must have been about nothing else (40% corresponds to a floor area ratio of 0.4 + 50% of 0.4 = 0.6 or 60%). There is no other basis for the prohibition. Sometimes you have to help the caseworker along ;-)
It might be possible to negotiate a deviation, exception, or exemption. The law allows for that.

No. The exceeding of the floor area ratio according to the land use ordinance can be excluded, with justification. For example here, if infiltration is a problem and too much sealing must be prevented. Period. We are allowed, for example, 40%, no more square meters. And that is a good thing. Who wants to live in a parking lot anyway.

Wrong. It is not stated in the legal text. What is, however, stated is: "...The permissible floor area (attention!) may be exceeded by the floor areas of the installations mentioned in sentence 1 by up to 50 percent, but at most up to a floor area ratio of 0.8..." and a further exceeding follows, which CAN be approved.

Once again, someone who thinks they are smarter than the building authority... A new building simply will not be approved here as long as the floor area ratio is exceeded. Period. The building authority has already said what it will approve and what it will not. That you still claim it would be possible... no words.
