Roof structure on conservatory construction - legal question

You can already submit the building application now. If it really gets rejected, you might still be able to save the additional costs for the reinforced conservatory structure.

We would like to do that, but the woman from the responsible building authority presented us with two options:

- now submit a complete building application for the entire project (house including extension with terrace)

or

- finish building everything as approved in the exemption procedure and then submit a building application for the extension

We will probably go with option 2, as we currently do not feel like having to submit a complete building application. For whatever reason that should be necessary...

By adding a roof terrace to the conservatory structure, the conservatory loses its character and thereby becomes an extension.

In terms of the tolerable building boundary exceedance, a conservatory here is probably meant as a fully glazed, transparent outdoor room including the typically shed roof. That such structures are rather privileged compared to more "massive" and multi-story extensions enabled by the roof terrace, I find understandable. I assume this conversion application (to extend a conservatory with a balcony) will be rejected. Then you will be annoyed by the additional effort required for the structural engineering.
