Hello

So, there is not really anything new yet. Waiting is just the worst!!!!
We have been to the lawyer by now. He has received all our documents and needs to go through them first. The next appointment is only on 25th August.
He has already skimmed through them when we explained the situation to him.
They cannot just take away the property with the semi-detached house from us so easily, as we are listed with reservation in the land register and payments have already been made that exceed the property's value.
The bank (owner of the other half) could only offer us to pay back the money already paid. Without the already paid interest and property transfer tax + notary.
We will know more only on 25th August.

The head of the developer called me the other day. He had a conversation with the bank. The house is definitely supposed to be completed. Now the insolvency administrator just has to take this into hand. It is possible that he can still turn things around with the developer and finish the house or that another construction company takes over.
Then there would be the problem again that a new construction contract would have to be concluded with a new company. If possible, we then only want to have the shell and roof completed and do the rest ourselves.

So now it's waiting again. The responsible banker of the bank is on vacation until the end of August. The insolvency administrator will come only in 1-2 weeks due to holidays and we also have the appointment with the lawyer only on 25th August.

Because some wondered here why we did not go to a lawyer right away.......I did not make that very clear.
My wife's colleagues, who have gone through the contracts, are professionals. They often deal with such cases and are up to date legally. But as I said, we have gotten a second opinion.

Hello,

Thank you very much for the update. And of course, lots and lots of success, hoping that everything somehow still turns out somewhat positive.

A time-to-time update would be great.

Thank you very much and best regards

Yes, as soon as I know something new, I will get in touch! We were just a bit overwhelmed. Now we have to wait and see what the insolvency administrator says. According to the documents, everyone tells us so far that they cannot take anything away from us. It just needs to be clarified how construction will proceed. Whether the company is allowed to finish it or if another company should do it.

Hello andy1983,

I am relieved that you have now sought help from a lawyer, because advice from experts about what to do - while nice and good - usually does not help when it comes to formally registering existing claims correctly. Concrete example: experts rightly advise you to exercise your right to property acquisition. The lawyer can give you this advice and at the same time enforce it for you. In addition, it usually carries significantly more weight when a lawyer writes compared to a private person. This saves you some nerves - and that is worth a lot during construction.

In any case, I wish you a lot of strength, good nerves, a cooperative insolvency administrator, and a strong-willed lawyer on your side for the further project.

You also write that you "Wenns geht wollen wir dann nur bis zum Rohbau und Dach fertigstellen lassen und den Rest selber machen"
I also want to advise you against this - otherwise, you would never be finished. I will spare you a calculation.

If you have not learned these professions or have someone who sacrifices 1-2 weeks of their free time and has learned it, then keep your hands off - it only provokes botched work.

I would be happy about further updates, possibly also photos!

Best regards

Yes, I also had problems with my construction company, but it was by far not as dramatic as with you. The dispute dragged on endlessly and ultimately went in my favor. It is really outrageous what some companies allow themselves. In some cases, simply false claims were made. It's just as well that I was able to document everything thoroughly. That was time-consuming, but I probably would never have found out more by scanning receipts otherwise.

Hello guys!

After a long time, I’m back.
The short version......
A couple of friends acquired the other half very cheaply. We didn’t have to pay anything more and everything was transferred to us. We basically received the earthworks and the first floor in shell construction as a gift.
We have now been living in the house for a month. We did a lot ourselves and some things with companies.
All’s well that ends well!!!!
