Plot with old walnut tree (BW)

Hello everyone,

we possibly have a plot of land in sight on which an old walnut tree stands. It is quite large and old (I think about 40-50 years old) and would of course have to be felled.

This tree stands almost on the border to the neighbor.

Is there a law/regulation that could prevent felling? Could the neighbor object?

Hope someone is familiar with this. Federal state Baden-Württemberg.

Check online at your city under [Baumschutzverordnung]. Tree protection usually applies from a trunk circumference of 80cm at 1 meter height. Walnut is considered a species worthy of protection. Therefore, a felling application as well as permanent replanting is necessary.

Why does the "natürlich" have to be felled?
Is it located in the building envelope?

Tree protection is regulated locally. Ask the municipality/city/district.
You probably need a special permit.

However, it would be a pity to lose a great tree. An architect may possibly help to find a tree-preserving solution.

We had a huge pasture in the building plot and had great concerns. But actually, the permit was no problem; we were told that new construction projects are usually not obstructed. With the replacement planting, they were surprisingly flexible. One thing to keep in mind is that no felling is allowed during the nesting period from March to September.

In the family, we had a beach promenade property in Usedom with old trees. The property could only be sold with a permit to fell trees. The negotiations lasted years and several solution proposals were submitted. Eventually, one proposal was accepted. Today, there is a hotel there, and many trees could be preserved. Everyone who wanted to make quick money from the sale ([Erbengemeinschaft]) thought that was stupid. I found the behavior of the municipality prudent.
