Either it is an unplanned inner area (§34 Building Code) or an outer area (§35). What may be built in each case is specified in the paragraphs. The demarcation is usually made by the planning office. However, the criteria are not clearly defined, so one is at the mercy of the assessor's judgment. A counterargument or even legal dispute is likely to be futile. The land use plan provides a clue. If residential or mixed-use building land is designated here, this indicates §34. However, these designations are generally not precise to the parcel level, and at a scale of, for example, 1:20000, the area boundaries can only be determined very roughly. If there has been coordination between the building authority and the planning office regarding the inner area demarcation, a purely residential house is not approvable there, regardless of what the realtor says.
