An indication is provided by the payment plan according to para 3 II Broker and Developer Ordinance.

However, it does not fit directly, as the purchase price for the land is still nominally allocated at 30% upfront.

According to the Building Code, the principle applies that the general contractor is obliged to provide advances; Section 632a of the Building Code is legally the exception but in practice the rule.

Hello Sascha,

Your general contractor sets "only" 8 payment steps; trying to achieve a change within these advance payments only works if your general contractor is willing to completely adjust his payment plan; I can hardly imagine that. Something like this:

    [*]12% after the start of earthworks and completion of the base slab

    [*]13% after installation of the attic ceiling

    [*]13% after shell completion

    [*]13% after completion of the facing work (with grouting)

    [*]16% after window installation, after mounting the gutters, roofing of the roof surfaces and after the rough installation of electrical, sanitary and heating work

    [*]15% after completion of drywall work, interior plaster, screed work

    [*]15% after completion of electrical, heating and sanitary work

    [*]3% after handover (acceptance) and before moving in


That is in my opinion the right approach. What do the securities of your preferred provider say? Completion or warranty bond?

Why do you tend towards 5%? Do you have a warranty bond in the contract? Have you agreed on a retention?

We have 17% as final payment AND 5% bond.

Our payment plan lists as the last item "17% after completion of the brick facade, overall completion and acceptance." Since the brick facade has long been finished, the general contractor wanted to have 30,000 euros in advance (I have roughly addressed this above). We did not agree to that (thanks, construction expert ). Construction is proceeding normally anyway. Not overpaying is one of the most important things for me during construction.
