Hi everyone,

first of all, thank you for your answers. I read that in NRW it is as follows: conservatories must not exceed a maximum gross floor area of 30sqm to be exempt from approval. My question is, is that the roof area including gutters etc., or does the outer wall including plaster etc. count? The gutter is, after all, a bit further outside. Furthermore, our conservatory is not supposed to have a glass roof; from when is a conservatory considered a conservatory? I do want to install high-quality windows with appropriate insulation.

In the relevant legislation, I know of no definition. The Federal Association of Conservatories e.V. states: A conservatory is a closed extension to a building, a standalone structure, or a construction integrated into the building with at least one wall surface and most of the roof area made of light-transmitting materials. A conservatory is a rainproof, airtight, and windproof lightweight structure that is separated from the outdoor climate. According to this, if you omit the glass roof, you are not building a conservatory but a shed as an extension to your house...

Is there boundary construction here or less than 3 meters distance to the neighbor? Is there a development plan or does §34 apply? At the property boundary, for example, only garages, greenhouses, or storage rooms are permitted.

How large a garden house may be varies from municipality to municipality. In North Rhine-Westphalia, the permit-free limit according to the state building code (Bauordnung NRW) is 75 cubic meters of volume (important: gross volume without living spaces, stables, toilets, or fireplaces). Nevertheless, this does not mean that other regulations do not have to be observed.

According to the definition, a garden house is a building that is used temporarily and must under no circumstances be considered living space. This means it may not have a kitchen or a bathroom. And it should be easily removable again. A little house that is firmly connected to a concrete foundation is no longer a garden house according to the definition.

okay, we’ll think about whether to install some roof windows after all. Can I come back to the question of how the GFA is calculated? Does that only include the exterior walls or also the roof overhangs, eavestroughs, etc.?
