New construction on private property allegedly not possible/wanted by the authorities?

Ok, Maria brings up a point that is important. It might be about building in the second row? So the father's 3500 sqm are behind his house? Not next to it! And in the land use plan, what are the father's 3500 there? Grassland? Arable land? Building land? Forest? Additionally, if it is, let's say, grassland, then it will become building land if they approve your [BV]. You will not want to use 3500, but let's say 700. The rest is now easily sellable for Dad. Since he himself sits on the council, there is a suspicious undertone. Karsten

The property is directly on the main road, not in the second row or anything like that. To the right (towards the town exit) my father lives. To the left (towards the town center) the next house is set back a bit. But it is already somewhat older. There is also this "OD stone," no idea exactly what it is for. It stands quite far to the left. So almost at the end of the property (true town center). Although the building authority said this "OD stone" has nothing to do with the development at all.

So there is no written rejection notice? On what basis do they want to sue?

Who knows, maybe there was a cheeky intern on the phone at the building authority?

I would submit everything in writing and let it take its course. Such casual phone calls really make no sense here.

Edit: and consider whether the VitaminB dad might possibly be an emetic for the building authority.

Have you ever been there in person at the building authority? That can help enormously when they suddenly have a face to the case. It worked wonders for us regarding the garage. Do you have a small child? Bring them along! They didn't want to quickly add our garage to the building application. So my husband went there and wanted to show the caseworker something on his phone, whereupon she saw a photo of our three cats, and suddenly they were on the same page. She is very much an animal lover, and we have a rescue cat. The end result: my husband was allowed to quickly add the garage, and from then on, we had a personal contact person for any problems.

Who did you speak to at the office? If I understand you correctly, it is not the municipality that is against it, but the district? If so, I would do it as Evolith suggested and speak to the person responsible who rejected it. Did you submit the preliminary request through an architect? That does cost a bit, but they have the necessary experience and knowledge. And if none of that helps, have the rejection notice given in writing and take action against it.
