Neighbor's tree - Security and dirt. Who is responsible?

Hoihoi,

I reminded my neighbor again today.
He doesn’t care. He said we also have insurance. That was his further response. I can gladly cut the branches.
Now I am supposed to leave it and not ring the bell anymore.

Honestly, dear community, new neighbor or not... one has a certain duty of care to fulfill.. right?

I wouldn’t get upset or hung up on that at all if I were you. Do your thing, chop off the parts, and be happy. And if now the thing with “what if he files a complaint afterwards” comes up, then so be it. I wouldn’t worry about that either. Because nobody wants to make a state act out of something like that!

Maybe you can prepare a short power of attorney on the computer and slip it into his mailbox, asking him to sign it. Although it may seem bureaucratic to him, that way you'd be on the safe side. The comments from some forum members here regarding compensation, etc., if the tree falls in a few months, seem quite worth considering to me.

So I still don't see your problem. Just cut off the overhanging branches and that's it. The rest is his problem. Again my question: would the trees fall on surrounding buildings if they were to fall?
