KFW 55 in semi-heated basement - cold basement

The text stating that the client can withdraw was something I demanded to be included to protect myself. Of course, I have no desire to install a pseudo electric radiator in the basement rooms without underfloor heating just to pass the inspection, let alone operate it. The KFW 55 goal was to save energy, not to increase it. I have now written to the house building company again:

Good day Mr .....,
So that no misunderstanding arises: I do not want to operate an electric heater in the unheated basement rooms, nor do I want to place a pseudo heater just to provide proof of heating during inspection by the KFW appraiser.
The ordered house is supposed to meet the KFW 55 requirements according to the construction contract as it was ordered (with partially heated basement). With the necessary insulation package as stated in the contract.
Please do not misunderstand me, I just want to have confirmation that the house meets the KFW 55 standard without pseudo or separately operated electric heaters.
Furthermore, I am obligated according to KFW to appoint my own KFW-listed appraiser who accompanies the entire energy efficiency related to KFW 55 and confirms it at the end.
I will consult them on how to proceed in this matter.


Let's see what the building company answers. According to today's phone call, the building permit should be sent to me within the next 2-3 weeks. According to the contract, construction work is to begin 4 weeks after the building permit is granted. The execution planning is not yet completely finished and also not yet approved by me as long as the KFW 55 issue is not clarified. I will now promptly consult a KFW-listed appraiser to discuss the whole matter. Thanks in advance for your interesting answers. I have already learned a lot through Hausbau-Forum.de.....

That is the right decision! Ask during the call which documents he needs so that you can possibly have them obtained by your provider by the agreed appointment.

Hello construction expert. No, I have not spoken to an expert yet, because I first wanted to know what the construction company says about it. Thank you, construction expert. During the conversation with the construction company, I already had the impression that they do NOT want to take advantage of me. The conversation was calm, without emotions, factual, and I also believe honest. I think that when the contract was signed, the seller went a bit overboard and did not consult with his superiors or specialists regarding the partial heating in the basement. (First sign, the main thing). I have expressly demanded the right of withdrawal if KFW 55 is not achieved. I am very curious to see how it turns out.

Hi,
if the cancellation clause came from you, it might really have been a somewhat overenthusiastic salesperson. That way, the contract structure doesn’t really make sense for the construction company either.

So actually, you don’t have a bad hand for now. Only regarding the bigger heating system (if it is really needed), you probably won’t get out of that. It’s explicitly stated there.

That initially reads very well; even if you are a declared layperson, your gut feeling is still a good barometer

I cannot imagine that a provider – except for the well-known candidates, of course – would deliberately produce paper just for filing under "P". Accordingly, I am confident that an amicable solution will be reached. However, I would still not accept a "crutch," as proposed; I am convinced that the expert yet to be commissioned will see it similarly.

I am curious to see how this will be resolved for you.
