Hello Hello,

after much back and forth, we have received an appointment to erect our house on November 25, 2020. At the beginning of September, we took the base slab out of the scope of services of our prefabricated house manufacturer and did it ourselves so that the house could still be erected this year.
Then today we got a call from our house manufacturer that the window company delivered the windows incorrectly (exterior color inside and interior color outside) and the erection appointment has been postponed indefinitely.
I understand that there is nothing we can do to have the house delivered this year, but is there a claim for compensation? Should we get in touch with a lawyer?

Thank you already for your thoughts and opinions.

Best regards
Susanne

I believe there is no claim for compensation, why should there be. You will get your house, even if later. And your prefab house manufacturer will find an excuse anyway, after all, he can't do anything about the windows. Even if it sounds stupid, it looks to me like tough luck :(

Which Stell/Bezugsfertig date is contractually agreed upon?

Why is the appointment date important? The reference acceptance date is more decisive, see contractual penalty etc.

We received a letter from our company on 21.10 stating:

the preliminary work for the house assembly has been completed. The production of your Lehner house is currently in progress, therefore we have scheduled the installation of your house for 25.11.2020.

I don't think the contract says anything about the installation date, the only thing in the contract is that after the completion of the foundation slab, the house will be delivered no later than 8 weeks afterwards. (but I need to check that more precisely)

We have no contractual delivery date (in hindsight really stupid that we don't have something like that, but you are always wiser afterwards than before)
