Me too!!! I briefly read through the thread from 2021. Is it still the case that you want to build a two-family house together with your mother? Then it is probably the case that you want to extend the residential building to the back, attaching it to the shed? Do you still have the architect? Did he prepare the documents for the building authority for you?

If not everyone is confused by now... The 5m distance comes from fire protection; if you fall below this, a fire wall must be erected (without openings, etc.). If this applies, then the neighbor does not have a fire wall and this fact must be recorded as a burden on your land register.

No burden is registered in the land register.

The building authority now wants to check whether the building approved as a stable by the neighbor is being used as living space. If he does so, we must maintain 5 m, without windows on that side. Otherwise 6 meters if there are 5 windows. The building authority also now wants to check whether our building is not too large. That other neighbors have built as large or larger in recent months is dismissed with “Yes, maybe that was not approved at all.” Well... If others are allowed to build as they please without approval – then maybe it’s better if we build without it too.
