House bought. Termination of liquefied gas contract

Hey,
so with Primagas it’s kind of a thing, we had the same problem.

We bought our old house from my father, he had a Primagas tank including a contract.
After the purchase we called, 2 possible options: No.1: we change the contract to our name - we were massively bothered by the prices and the fact that you can’t refuel anywhere else - all other suppliers won’t deliver to you if you can’t prove that the tank is yours!
No.2: We cancel the contract and they pick up the tank for a fee - it was about 150 euros (5 years ago).

We canceled and got ourselves a tank, you can refuel freely and over the year that’s a lot. We also had a 2700 lt tank, including delivery, full TÜV and so on and in the end we paid something around 2000 euros.

Think carefully about Primagas, they’re insanely expensive, in our region they charge almost twice as much as independent suppliers.

Thanks for the feedback Tina,

I am also strongly inclined not to stay with Primagas. It's just extortionate. When I hadn't even read into it yet and the employee basically knew that, he wanted to sell me this price here as very cheap.

On Wednesday I'll call him and see what can be done. Just the fact that he tried to rip me off like that basically destroyed my hope for a future trusting cooperation.

I wanted to give you an update and at the same time I have a question:

After a lot of back and forth, we have now received the offer to be able to buy the tank later on (at the earliest after 2 years), if we are no longer satisfied with the conditions. This will be regulated by a separate contract, which I already have. This was only possible due to a special situation.

I could live well with this "emergency clause". I am aware that it is still more expensive than acquiring our own tank, but it would be a good compromise for us.

My question now is whether this separate contract contains any pitfalls (basically as a general matter). It is mentioned there that it applies provided a delivery contract (which we also have) is valid.

Only a lawyer can assess that. One would need to know the wording and establish a reference to the [Liefervertrag].

I’ll jump in here again, firstly because I have something similar on offer and secondly because the following is not entirely clear to me: You write that you took over the supply contract from the previous owner. And you write that Primagas wants you to sign a new contract. Somehow that doesn’t add up. If the old contract was taken over, then you shouldn’t need a new one! Unless Primagas terminated the old contract. Or am I just completely missing something here? What were the conditions of the old contract (i.e. the previous owner’s) compared to the new conditions now being offered to you?

Quite simple - we had to take over all the contracts of the previous owners - but since one has the right to terminate these within one month after the land register entry, both what I wrote fits. Primagas then offered us a new contract when I called, but it was very bad. In the meantime, we have been able to agree on something acceptable and are reasonably satisfied with the solution.

The old conditions of the previous owners were also very bad. far (very far) above 2 euros/m³
