Height of privacy screen with height difference to neighboring property

Hello,

there is a height difference of approximately 70cm between our property and the neighboring property. We are higher, which is why we have built a retaining wall on the boundary. Now we want to erect a privacy screen on this wall.

My question: how high is this privacy screen allowed to be? We are in BW, where a privacy screen on the property boundary is usually allowed to be 1.50m high. But how is it with a height difference? Do I measure the 1.50m from our higher property, or do I measure from the lower property?

As far as I remember (please check in the Landesbauordnung!) the height is measured where the privacy screen is located. So in this case on your property. As far as I also remember, unlike the enclosure, the privacy screen must be on your property and not on the boundary, and it must not be attached to the enclosure, otherwise it becomes part of it, which means that the rules for the enclosure (especially regarding height) must be applied to the privacy screen.
