Garage arrangement boundary construction

Good morning everyone,

the choice for the company that will build the turnkey house for me has now been made.

Now it’s time for the planning and layout on the property.

Can anyone tell me if what I have shown in the picture is allowed?

Specifically, building on the boundary to the street, but with the gate on the side so that traffic is not obstructed.

As far as I can see, in Bavaria a boundary construction with a maximum total length of 9 meters is permitted. With a 6 x 6 meter garage that stands on the boundary on two sides, this measure seems to be exceeded with 12 meters. Didn't we also discuss elsewhere ("Hausanordnung gemäß Bebauungsplan/Stellplatzsatzung") that the development plan here requires a distance of 5 meters from the street?

Yes, that's right, the part about the 5 meters is written like that. But yesterday my [jem.] said during a discussion that it would be irrelevant if the gate is not facing the street. That's why I asked again.

There was already a suggestion to clarify the whole matter with the responsible building authority through a preliminary building inquiry. Has anything come of it?

That is not entirely correct, the 9 meters apply per property boundary, in total (at all 4 boundaries) it must not be more than 15 meters. Placing a 6 × 6 m garage in the corner is therefore basically allowed. However, from my experience in my city, the area towards the street must remain free, no matter where the gate is located. But that doesn't mean it is not allowed, I'm curious to see what you find out!

Hello, we are currently building exactly like this in Bavaria. The garage is on the boundary and the garage door + driveway run parallel to the roadway. We had to build this way because otherwise we would not have been able to comply with the 5m space in front of the garage.
