And exactly that shows that you didn’t understand me. Why is Heinz von Heiden responsible? Heinz von Heiden does not demand "something like that". Heinz von Heiden either requires a financing confirmation or a guarantee. However, the bank only issues a guarantee with a Heinz von Heiden contract. So who is the bad guy? Certainly not Heinz von Heiden if they want this or that. Whether they then also accept one or the other is another matter.

I knew that Heinz von Heiden wants either one or the other. There’s nothing wrong with that. Only afterwards it turned out that the bank only issues one, namely the guarantee and not just a simple financing confirmation (as I said, I’m still working on that). And exactly that I could not read out, recognize, guess or anything else anywhere, that the bank had defined it for itself that way.

That is nonsense. The bank does not want to sign the confirmation on the form from Heinz von Heiden, right? Have you ever asked for a financing confirmation created by the bank? By the way, you wrote in #1 that the bank does not sign the confirmation from Heinz von Heiden because it involved the assignment of the entire loan amount. So on the one hand, an assignment of a loan is not a financing confirmation and on the other hand, as already mentioned, why should the bank sign on a form legally questionable for the bank?? What you want to shift to the bank as their fault is really absurd.

Because everyone is building and does not demand such a regulation that disadvantages the builder.

Just think about it yourself... Heinz von Heiden basically has decision-making power over your loan... I would never ever build with a company that insists on such a regulation... but everyone is the architect of their own fortune!

Then present your loan agreement to Heinz von Heiden. Issue resolved, as this is a financing confirmation. If that is not enough, it is not the bank's problem, but the issue between you and Heinz von Heiden. P.S. Already 20 years ago, I myself as a bank rejected the probably still today similarly demanded assignment of the disbursement claim and would still do so today. And the normal financing confirmation has always been sufficient.

It isn’t, because what other scenario could have presented itself differently in this situation? And please do not judge from your/your bank’s point of view. You deal with this every day and these things are more familiar to you than to an outsider.

To be honest, you should pay the bank something extra for not signing the assignment. That is an action in your favor!

What happens with the paper demanded by Heinz von Heiden? It authorizes (colloquially speaking) Heinz von Heiden to demand the financing funds from the bank on your behalf. Defects or problems with the construction? It doesn’t matter, not Heinz von Heiden’s problem - they already have their money, even if you as the builder wouldn’t want to pay. With that document, you would give up the only leverage you have against your construction company. The ONLY ONE! MONEY, otherwise you have nothing in hand.
