Sorry, 0.5*166.38. I accidentally multiplied the floor area ratio by 0.5 instead of the area.

With which 0.5?


§3 only mentions an exception in 3. here, and otherwise does not mention any surcharge (except in 1. for the terraces, but valid for WA2 and WA4).

According to § 19, the floor area may be exceeded by 50% for garages/parking spaces + driveways.

I had mistakenly thought that I had to take 50% of the floor area ratio allowed for this permitted exceedance and multiply it by the plot area. But the 50% refers to the floor area, not the floor area RATIO.


§ 6, however, allows the construction of garages outside the floor area.

This development plan, however, does not intend to utilize this scope and does not mention any such second floor area number, except for the mentioned exceptions (which do not apply here). No, outside the buildable areas. This refers to building distance garages, but says nothing about a (not even usual) non-inclusion of the garages, as you would like to interpret it. Unfortunately, a development plan is not a wish concert for creative interpretations.

You seem to be very knowledgeable, but shouldn't the development plan under §3 explicitly restrict the rules on garages contained in the Baunutzungsverordnung §19 (4)? Just because it explicitly allows certain deviations does not automatically revoke other deviations permitted at a lower ranked level...
