Why should it do that? The granted price lock applied for the specified period during which you then failed to start. Therefore, the matter is settled! I would definitely be surprised if the construction company felt bound to the price for significantly longer than I say, about a month or so.

Then this clause is one that unilaterally favors the entrepreneur without any consideration. It even corresponds to an additional profit. The clause may therefore possibly be invalid.

Why does she favor the entrepreneur? She guarantees the client a fixed price for a certain period if he begins construction within this period or has the construction started earlier. If this does not happen due to his fault, the price commitment becomes void and the price is essentially reset at the start of construction.

So, if the reasons why the construction did not start within the intended window lie with you, it is your problem. You then failed to start construction within the price commitment and now have to accept the price increase based on the index. If you had started on the last day of the deadline, construction would have been carried out at the agreed price.

A special offer in the supermarket is only valid for a certain period of time. If you don't manage to shop during this time, you just pay the regular price or wait for a possible new special offer.

Let’s assume I started construction 2 days after the fixed price period ended, then the contractor would have pocketed the increase for the entire time since contract conclusion instead of just for 2 days as profit.

Furthermore, I still don’t understand, if everything possible is done on my side but the start of construction is delayed by winter, then it is no longer my fault, right?
